A Facebook Ellenőrző Bizottság működése és bíráskodása a gyűlöletbeszéd kontextusában

A jelen tanulmány a Facebook Ellenőrző Bizottsága gyűlöletbeszéddel kapcsolatos esetjogát tekinti át és elemzi. Központi eleme a 2021-től 2023 februárjáig tartó időszak összes, a platformon megvalósult gyűlöletbeszéddel kapcsolatos és a bizottság elé utalt ügy tényállásának bemutatása. Az esetjogi ismertetés két célt szolgál: egyfelől mutatja az esetek változatosságát, másfelől rávilágít a Facebook moderálási tevékenységének ellentmondásosságára. A tanulmány röviden bemutatja a bizottságot mint a Facebook moderálását ellenőrző testületet, majd az esetjogi analízis kapcsán annak hiányosságait is, kiemelve a bizottság strukturális, szabályozási és általános irányítási problémáit. A szakirodalmi áttekintésen és az esetjogi összehasonlításon túl három konstruktív javaslatot is teszünk, amelyek segítségével a bizottság és a mechanizmusai megbízható módon és nagy hatékonysággal tudnának működni.
