Provisions of the DSA and DMA Regulations Affecting Consumer Contractual Relations Concerning Digital Goods and Services

Abstract

European legislation is moving forward to give users and consumers in the digital space a meaningful possibility to seek redress in cases where they are affected by infringements. The development and expansion of the internet and the e-commerce and digital services available through it, particularly during and after the pandemic period, underlines the importance of ensuring that European consumers enjoy a higher level of (legal) security in the world of platforms, while the European legislator must also ensure that regulation does not have a chilling effect on competition and innovation, particularly in view of the competitiveness of emerging, smaller platforms. The aim of this paper is to provide a critical analysis of the requirements of the Digital Marketplaces and Digital Services Acts, which will enter into force at the end of 2022. The research question of the study is to what extent and in what direction the new regulatory package of the two Acts under examination represents a shift from the previous regulatory approaches, and whether the two EU standards to be introduced will guarantee more effective legal protection in the digital space.
